Where it hides

The bandHow far they can raise it depends on how far below the going rate you already are. Five steps, capped at twenty per cent, and most tenancies sit nowhere near the top.
The feesFive per cent commission is a habit, not a law — and on a renewal, where no new tenancy is being sourced, there is no customary basis for it at all.

The part most people leave out. There is no route to a rent reduction. None. The rules cap what they can add and say nothing about taking any away. Anyone promising to get your rent lowered is confused or selling — and claiming a right you do not have is the fastest way to lose the ones you do.

The whole method

The situation

A one-bedroom flat. Current rent AED 92,000, tenancy expiring 31 March. On 20 January a notice arrives proposing AED 112,000, and the agent asks five per cent commission to process the renewal.

1 · The dates20 January to 31 March is 70 days. A variation of terms on renewal requires ninety. It is short by twenty, and where that interval is not met the tenancy renews on its existing terms — putting the whole AED 20,000 in play.
2 · The bandEight registered contracts, same building, same size, last twelve months: AED 95,000 to 104,000, midpoint AED 99,500. The current rent sits 7.5% below that — under ten, so the permitted increase is zero. AED 112,000 was never available.
3 · Counted onceThe defective notice puts AED 20,000 in play. The over-band figure is also AED 20,000 — the same money reached two ways. Counted once, not twice. Adding them would give AED 40,000 and would be wrong.
4 · The commissionFive per cent of AED 92,000 plus VAT is AED 4,830. No new tenancy is being sourced, so there is no customary basis for it — but no rule forbids asking either. Negotiable, not not-owed.

Judge the writing before you spend anything. Bracketed parts are filled from your own paperwork; the complete documents are what you receive.

Extract — negotiation letter · renewal

First, the date of the notice. A change to the terms of a renewal requires ninety days’ written notice before expiry. Your notice is dated [date], which is [n] days before expiry. On that basis the existing terms would carry into the renewed period.

Second, the increase itself. On the figures I hold, the current rent of AED [current] against a comparable range of AED [low] to AED [high] places this tenancy in the band permitting [x]%. The proposed increase is [y]%.

I am not asking for a reduction and I recognise none is owed. I am asking that the increase be brought to [x]%, and that we sign promptly on that basis.

Extract — landlord position statement

Notice of the proposed variation is dated [date]. Expiry is [date]. The interval is [n] days. The requirement for a variation of terms on renewal is ninety days’ written notice. Where that interval is not met, the tenancy renews on its existing terms.

The comparable evidence relied upon is listed at Appendix A: [n] transactions in [community] between [date] and [date], at annual rents of AED [range]. On that evidence the current rent sits [x]% below the comparable figure, placing the tenancy in the band permitting an increase of [y]%.

The tenant does not seek a reduction and accepts that none is owed. The request is limited to bringing the increase within the permitted band.

Why there is only one price. A cheaper version would have to leave out the Position Statement — the only document here that reaches the landlord’s side of the table. Selling you the rest without it would be selling you a case you cannot make.

Fair. Take it — the bands are public and you owe us nothing for them. Holding the rule itself hostage would have been a poor way to treat you.

What the table cannot tell you is which row you are in. That depends entirely on what comparable units actually transacted at, which sits in registered contracts and never appears in a listing. Without it the table is five rows you cannot place yourself in. And you still do not have the letter, on your figures, in the register that gets a reply rather than a shrug.

Then we say so in writing, and you have a document confirming the increase is lawful and the notice was good — which is worth knowing before you spend three weeks arguing with someone who is right.

No. And nor can anyone else, which is the more useful half of that answer.

The rules cap what a landlord may add at renewal. They say nothing whatsoever about taking any away. A reduction is something a landlord agrees to, out of goodwill or fear of an empty flat, never something you are owed. Anybody telling you otherwise is guessing or selling.

What we can settle is whether the increase sits inside its permitted step, whether the notice arrived in time, and how your rent compares to what places like yours actually let for. Those questions have answers. That one does not.

Most of the time they do not, once the position is put formally and with the evidence attached. That is what the Position Statement is for — it reads like something that has been prepared rather than felt.

If it does not settle, the Rental Dispute Settlement Centre exists: 3.5% of the annual rent to file, minimum AED 500, and no lawyer required. We will tell you honestly whether the sums justify it. Often they do not, and we would rather say that than sell you a fight.
